The extensive knowledge on urban regeneration to date focuses either on owner-occupied or on rental housing, largely ignoring condominium tenure. Yet, this type of tenure represents a major part of the housing stock globally, and much of it needs demolition (dissolution) or other major interventions. redevelopment offers multiple benefits, but a key obstacle is the requirement for unanimous owner consent. Only a few countries have amended their laws to allow for lower special majorities, with even fewer having implementation experience.
This research examines special majority rules in three jurisdictions with significant practice: Israel, Turkey, and British Columbia, Canada. It focuses on minority owners’ rights in demolition projects, dispute resolution mechanisms, and the legal considerations applied. The cases are evaluated using normative criteria, including transparency, distributive justice, and public urban objectives.
